Terms of Use

These terms are an agreement between you and Baseline Logic LLC, a Colorado limited liability company ("we", "us"), for the Notch iPhone app, its online sync service and this website (together, "Notch"). By using Notch you agree to them. If you don't agree, please don't use it. Our Privacy Policy explains how we handle your data.

1. Using Notch

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Notch on Apple devices you own or control, as permitted by the App Store's Usage Rules.

Purchases

Notch includes a number of free notches. After those, more may be offered as an in-app purchase. Purchases are made through Apple, and Apple's terms apply to payment, billing and refunds. We never see your payment details. Prices are shown in the app before you buy. A notch you have already made stays yours whatever happens to pricing.

You must be at least 13 years old to use Notch. If you are under the age of majority where you live, you need a parent or guardian's permission.

Please don't:

• reverse engineer, resell or redistribute the app itself;
• use automated means to access our sync service, or get around its limits or security;
• use Notch to break the law or to track, harass or harm anyone.

2. Your account

An account is optional and uses Sign in with Apple. You are responsible for what happens under it. You can delete it at any time from the app. We may suspend or delete accounts that break these terms or put the service at risk. If we do, we'll tell you when we reasonably can, and the tiles on your phone stay yours.

3. Your tiles and files

The tiles you make, and the physical pieces you cut from them, are yours. You may use them personally or commercially, including making and selling engraved pieces, subject to the map-data terms in section 4. You give us only the permission we need to store and sync your notches for you, and that permission ends when you delete them.

4. Map data and attribution

Notch draws its maps from Overture Maps Foundation data, which includes OpenStreetMap contributions licensed under the Open Database Licence (ODbL), along with other openly licensed sources. Every exported SVG carries an attribution line in its description. If you pass a file on, keep that line. If you sell cut pieces, credit "© OpenStreetMap contributors, Overture Maps Foundation" somewhere reasonable, such as the listing or the back of the piece.

Map data is made by people and is sometimes wrong, out of date or incomplete. Notch is for making keepsakes and art. Don't use it for navigation, surveying, property boundaries, or anything where accuracy matters for safety.

5. Lasers, printers and safety

Notch makes files. It does not run your machine. Laser cutters and engravers can cause fire, burns, eye injury and toxic fumes. You are solely responsible for:

• following your machine manufacturer's safety instructions, including eye protection, ventilation and never leaving a running laser unattended;
• choosing materials that are safe to laser (never PVC or vinyl, for example);
• checking every file before you run it, and setting your own speed, power and passes;
• any damage to your machine, materials or surroundings.

The same goes for any 3D-printed holder: print and hang it at your own risk. The holder designs are published on MakerWorld under the licence shown on that listing.

6. Our stuff

The Notch app, its name, logo and design belong to Baseline Logic LLC. These terms don't give you any right to use them except to use the app. Third-party software in the app, such as MapLibre Native, is used under its own licence, listed in the app's About screen.

7. Changes and availability

Notch is a small project, run to cover its costs. We may change, pause or stop any part of it, including the sync service. If we plan to shut sync down, we'll give reasonable notice where we can so you can make sure your collection is on your phone. Tiles on your device keep working without it.

8. No warranty

Notch is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent the law allows. We don't promise that Notch will be error-free or uninterrupted, or that files will cut exactly as previewed on any particular machine or material.

9. Limitation of liability

To the fullest extent the law allows, Baseline Logic LLC and its members are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, materials, profits or property, arising from your use of Notch or of files made with it. This includes damage or injury from operating a laser or 3D printer. Our total liability for any claim is limited to US $50. Some jurisdictions don't allow some of these limits, and in those places they apply only as far as the law permits.

You agree to indemnify us against claims arising from your misuse of Notch or your breach of these terms.

10. Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Colorado, and you and we consent to their jurisdiction. This does not take away any consumer protection rights you have under the law of the country where you live.

11. Apple

These terms are between you and Baseline Logic LLC, not Apple. Apple is not responsible for Notch or its content, and has no obligation to provide maintenance or support for it. If Notch fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Notch. Apple is not responsible for addressing any claims relating to Notch, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone's intellectual property. We, not Apple, are responsible for investigating and resolving any such claim. You confirm that you are not located in a country subject to a US Government embargo or on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes to these terms

We may update these terms. We'll change the date at the top, and flag significant changes in the app. Continuing to use Notch after a change means you accept it. If any part of these terms is unenforceable, the rest still applies.
